The following English translation is provided in good faith for illustrative purpose. In case of doubts or inconsistencies, the Italian text (in the lower section of this page) shall prevail. General Conditions of Sale
1. Summary of the main conditions of sale
1.1. These General Conditions govern the distance selling service of Products, as defined below, on the website elixar.it (hereinafter elixar.it or the Website) by Elixar SRL (hereinafter the Service) based in Via Ponzetti 12 Ponteranica 24010 (Italy), registered at the Chamber of Commerce of Bergamo C.F. and VAT number 04684960166, (hereinafter Elixar or the Seller).
1.2. Before making your purchase, we invite you to read these General Conditions of Sale in their entirety; However, we indicate below the main terms and conditions of the Service:
RECIPIENTS: only consumers (physical persons who act for purposes not related to their commercial, entrepreneurial or professional activity that may be carried out) of age above eighten (18).
PRICES AND PRODUCT PRESENTATION: Product prices are expressed in Euros, include VAT and DO NOT include shipping costs, the images of the Products offered for sale on elixar.it may not correspond to the real ones due to the effect of the Internet browser and the monitor used.
PURCHASE METHOD: to purchase one or more Products, you must carefully fill in a Purchase Order and send it to the Seller electronically (which is valid as a contractual proposal). The Purchase Order summarizes the information on the essential characteristics of each Product ordered and the relative price, the means of payment, the delivery methods, and the shipping costs. By submitting the Purchase Order, you confirm that you know and accept the General Conditions of Sale.
ORDER PROCESSING: following receipt of the Purchase Order, Elixar sends confirmation of its acceptance or indicates the reasons why the order will not be processed. The shipment takes place only after the regular registration of the payment within thirty (30) days of receipt of the Purchase Order. In case of purchase of Products belonging to distinct product categories through a single order, the Products could be delivered to you at different times.
WARRANTY: all Products available on elixar.it are guaranteed for defects of conformity appearing within twenty-four (24) months from the delivery while taking into account the nature of the product and excluding normal wear and tear or incorrect use of the product.
RIGHT OF WITHDRAWAL: You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within ten (10) working days starting from the day of receipt of the Products purchased on elixar.it. On how to exercise this right, see article 8.
PERSONAL DATA: for information on the methods and purposes with which your data is collected and used, please read carefully the privacy policy published on this site.

2. Exclusive recipients of the Service
Recipients of the Service are exclusively those who cumulatively reach the following requirements: (a) consumers (pursuant to and by effect of Legislative Decree 206/2005) understood as physical persons who purchase Products on elixar.it for purposes not related to commercial activity , entrepreneurial or professional possibly carried out; (b) adults (according to the laws of their country of origin); and (c) resident in one of the following countries: Italy, the Republic of San Marino, Vatican City and countries of the European Community.
3. Information and price of products and services
The products and services available on the elixar.it website are:
- wellness products and in particular: ingredients, flavours, spices, essences, oils, perfumes, creams, materials, wood, fabrics and leather for the olfactory, visual and tactile design of places, food and clothing.
- software and hardware devices for extracting, blending, spreading, cutting, assembling and using such wellness products.
- wellness equipment and in particular furniture, decorative and collector’s items, books, toys, virtual and physical games.
- booking of training and coaching, physical and mental training lessons, and relaxation and well-being techniques.
All information on the essential characteristics of the Products is provided in the identification sheet of each of them. The prices of the Products are expressed in Euros and include VAT. Shipping costs are excluded, unless otherwise expressly indicated. The prices indicated on the Site may be subject to updates, therefore we invite you to check the final sale price before submitting the relative Purchase Order.
4. Execution of the Purchase Contract
4.1 To execute the purchase contract for one or more Products on elixar.it, after having selected the Product or Products of your interest, you must first complete and send the Seller electronically a Purchase Order for the selected Products in electronic format (which counts as a contractual proposal), indicating the Products you are requesting to purchase, the chosen payment method and some of your personal data necessary for delivery (hereinafter the Purchase Order).
4.2. The Purchase Order consists of a „Personal Data“ screen in which the user must indicate the personal data necessary for delivery and a screen for selecting and activating the chosen payment method (as better indicated in article 5 which follows). The Purchase Order also contains a summary of: information on the essential characteristics of each Product ordered and the relative price (including VAT), the means of payment available to purchase each Product, the methods of delivery of the Products, and of shipping costs. Before confirming the request to purchase the Products, by sending the Purchase Order, you will be asked to carefully read the information contained therein to correct any errors or omissions (and to print or record a copy), and to read and accept these General Conditions of Sale and the information on the processing of your personal data.
4.3. The Purchase Order will be archived in our database for the period of time necessary to process the orders (and in any case in accordance with the law). You can access your Purchase Order at any time, to monitor its status by connecting to the Site and accessing the „my orders“ section on your personal page.
4.4. The contract is concluded when the Seller receives and accepts your Purchase Order electronically, after verifying the correctness of the data relating to your order. The Seller may not process Purchase Orders: (a) which do not give sufficient guarantees of solvency or which are incomplete or incorrect, or (b) in the event of unavailability of the Products (if they are no longer available or for sale ). In these cases, Elixar will promptly inform you (and in any case within thirty (30) days from the day following the day in which Elixar has received your Purchase Order) by e-mail that the contract has not been concluded, specifying the reasons. If you have already paid the price of the Product and the shipping costs, you will be refunded the corresponding amount (as better indicated in article 5 below). In the event that Elixar intends to conclude the contract, it will send you, by e-mail, a receipt of the purchase order, containing a summary of the information already contained in the Purchase Order (General Conditions of Sale, Information on the right of withdrawal, information relating to the essential characteristics of the product and detailed indication of the price, means of payment and delivery costs).
5. Terms of payment
5.1. When submitting the Purchase Order, you will be asked to choose one of the following payment methods for the Products: a) direct bank transfer made out to Elixar SRL; b) Paypal; c) Visa and Mastercard credit and prepaid cards.
5.2. In case of payment by direct bank transfer, you will receive confirmation by e-mail of the bank details to which to make the transfer together with the purchase order receipt from Elixar. To confirm the payment, you must send a copy of the bank transfer receipt by e-mail with the O.R.C. number (Operation Reference Code) to the address administration@elixar.it. The payment and the related notification of successful payment must be made no later than five (5) working days from the date the Purchase Order is sent. Elixar will not process orders in the event of payments and/or communications made after the aforementioned deadline. We invite you to check the completeness and correctness of the references and essential elements of the bank transfer. Missing data or the absence of necessary references may cause delays in the fulfillment of orders and in the subsequent delivery of the Products.
5.3. In case of purchase using the PayPal payment method, at the end of the Purchase Order compilation procedure, you will be automatically directed to the PayPal login page. In this way, the amount relating to the order will be debited from your PayPal account upon receipt of the order by Elixar. In case of subsequent cancellation of the order, the refunded amount will be debited from your PayPal account. Under no circumstances will Elixar be held liable for any damages, direct or indirect, caused by delays in PayPal’s failure to release the committed amount. At no stage of the purchase process on the elixar.it website, Elixar is able to access or know your financial information. For each transaction made with your PayPal account, you will therefore receive a confirmation email directly from PayPal.
5.4. In case of payment made by credit card (Visa and Mastercard circuits), the financial information (for example, the credit/debit card number or its expiry date) will be forwarded, via encrypted protocol, to Bank Intesa San Paolo without third parties having access to it in any way. Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relative refunds in the event of any returns of the Products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or to report to the police or the commission of fraud on elixar.it. The price for the purchase of the Products and the shipping costs, as indicated in the Purchase Order, will be charged to your current account upon shipment of the purchased Products.
6. Shipping and delivery of Products
6.1. The shipment of the Products is carried out to the address indicated in the Purchase Order only after the regular registration of the payment of the relative order and upon payment of the price. No deliveries will be made to post office boxes. Except as provided for in Article 4.4 above, Elixar will ship the Products no later than thirty (30) days from the day following the day on which Elixar receives the Purchase Order.
6.2. We ship to Italy, the European Union and other countries except for legal restrictions and subject to the availability of freight services. Deliveries in Italy will be completed within five (5) working days from the date of shipment, with the exception of Saturdays, Sundays and holidays in general. Deliveries to other member states of the European Union will instead be completed within ten (10) working days from the date of shipment. The delivery terms indicated above are to be considered purely indicative, Elixar will not be in any way responsible for any delays in delivery due to causes not attributable to it.
6.3. In case of purchase of Products belonging to distinct product categories through a single order, the Products could be delivered to you at different times.
7. Product quality and guarantees
7.1. The Seller does not sell used Products or Products of lower quality than the corresponding standards offered on the market. You are aware and accept that the images and colors of the Products offered for sale on elixar.it may however not correspond to the real ones due to the Internet browser and monitor used.
7.2. All the Products available on elixar.it are guaranteed for lack of conformity occurring within twenty-four (24) months from the delivery. To exercise the guarantee, you can write to administration@elixar.it after reporting the defects in writing and send it together with the product, in the original packaging, together with the invoice and any accessories – to be addressed to Elixar according to the methods indicated inside the packaging of the product โ within one (1) month of discovery. However, we invite you to first contact our customer service by sending an email to the following address support@elixar.it as soon as possible after discovering the defects, to obtain further information on how to exercise the guarantee. Elixar reserves the right to verify the existence of the reported defect, and to carry out the repair or replacement only after this check. If, following this check, the defect does not result in a lack of conformity, the Seller reserves the right to charge the Customer for the costs of checking, restoring, and transport.
8. Right of withdrawal
8.1. You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason. To withdraw from the contract, you must first send an e-mail to administration@elixar.it, to obtain the return authorization code and must subsequently return the Products to the address that will be indicated to you by e-mail, delivering them to the courier for the shipment within fourteen (14) working days starting from the date of communication of withdrawal. You will be responsible for the shipping costs, including liability in case of loss or damage to the Products.
8.2. The right of withdrawal – in addition to compliance with the terms and methods described in point 8.1 above – is understood to be exercised correctly if the following conditions are also fully respected: a) The Return Form must be correctly completed, indicating the return authorization code communicated by Elixar and sent together with the product – accompanied by the purchase invoice – within fourteen (14) working days from the date of receipt of the Products by certified electronic mail sent to elixar@pec.it or by registered letter with acknowledgment of receipt sent to [Elixar SRL – via Ponzetti 12 – Ponteranica 24010 (BG) – Italy]. The right of withdrawal can be exercised within the same period, also through a communication via e-mail to the address administration@elixar.it confirmed by registered letter with acknowledgment of receipt – accompanied by the purchase invoice – sent within forty-eight (48) following hours; b) the Products must not have been used, worn, washed or damaged; c) the identification tag must still be attached to the Products with the disposable seal, which forms an integral part of the Products; d) the Products must be returned in intact packaging, adequately sealed with intact, original and complete packaging and contents; e) the returned Products must be sent to the Seller in a single shipment. In fact, the Seller reserves the right not to accept Products from the same order, returned and shipped at different times.
8.3. If the right of withdrawal is exercised following the methods and terms indicated in this paragraph 8, the Seller shall refund any sums already collected for the purchase of the Products. The sums will be refunded to you in the shortest possible time and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures pursuant to the following paragraph 9, once the correct execution of the terms and conditions indicated above has been verified.
8.4. If the methods and terms for exercising your right of withdrawal are not respected, as specified in this paragraph 8, you will not be entitled to a refund of the sums already paid to the Seller; however, you may get back, at your expense, the Products in the state in which they were returned to the Seller. Otherwise, the Seller may retain the Products, in addition to the sums already paid for their purchase.
9. Reimbursement times and methods
9.1. After returning the Products, the Seller carries out the necessary checks relating to their compliance with the conditions and terms indicated in paragraph 8.1. and 8.2. In the event that the checks are concluded positively, the Seller shall send you, by e-mail, the relative confirmation of acceptance of the returned Products..
9.2. Whatever the payment method you used, the refund procedure is activated by the Seller in the shortest possible time and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verification of the correct execution of your right of withdrawal and acceptance of the returned Products.
9.3. If there is no correspondence between the recipient of the Products indicated in the Purchase Order and the person who paid the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be executed by the Seller, in any case, towards the person who made the payment.
10. Intellectual Property Rights
The Elixar – Alchemy of the Senses brand, the Flame of Life logo, the OlfaTeam concept, the Infin’Em concept, and the perfume brands Alkyres, Olfimรฉ, Qelia, Zahemi, esKiss, Attar-Enos, Attar-Vea; as well as all other trademarks, whether registered or not, and all other distinctive signs such as company names, names and trade names, illustrations, images, logos, registered and unregistered designs, copyrights and patents („Intellectual Property Rights“ ), appearing on the Products or otherwise reproduced on the elixar.it website, on accessories or packaging, are and remain the exclusive property of Elixar SRL. Any reproduction, even partial, any modification or use of the Intellectual Property Rights, for any reason and in any form, without the prior authorization of Elixar SRL expressed in writing, is strictly prohibited. Any combination or use in conjunction with any other trademark, symbol, logo and more generally any other distinctive sign capable of forming a complex sign is also prohibited.
The Website may present photos, videos, courses, methods and citations of employees, agents, collaborators, pro-bono contributors or suppliers (for example in The Tribe). Such publications on elixar.it or on Elixar social media channels are subject to express agreements that may be exclusive between Elixar SRL and the subjects. In consequence, such contents shall not be misconstrued as part of the public domain.

11. Force Majeure
Elixar will be relieved of any contractual obligation to make or deliver and will not be required to pay any indemnity in the event of force majeure events that prevent the fulfillment of obligations placed on it, such as, but not limited to, riots, insurrections, social unrest, sanitary crises, telephone or computer breakdowns or serious damage to the security and operation of the internet, strikes and impossibility of supplying Products and materials.

13. Applicable law and dispute resolution
13.1 The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206 (Consumer Code) with specific reference to the legislation on distance contracts and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.
13.2. In the event of disputes between the Seller and each end user, arising from the General Conditions of Sale, the Seller guarantees, as of now, the full adhesion and acceptance of the service of the Italian Association for Electronic Commerce (AICEL) and the Online Dispute Resolution (ODR) platform. The ODR platform is an independent and institutional service, provided by the European Commission, which allows a satisfactory agreement to be reached, with the help of a neutral and competent conciliator, in a friendly and secure manner, on the Internet. For further information on the AICEL or the ODR platform regulations and to send a conciliation request, you can access aicel.org or ec.europa.eu/consumers/odr.
13.3 The competent court is that of residence (or domicile) of the consumer.

GARANZIE: tutti i Prodotti disponibili su elixar.it sono garantiti per difetti di conformitร manifestatisi entro ventiquattro (24) mesi dalla consegna pur tenendo conto della natura del prodotto ed esclusa la normale usura o un utilizzo scorretto del prodotto.
DIRITTO DI RECESSO: Lei ha il diritto di recedere dal contratto concluso con il Venditore, senza alcuna penalitร e senza specificarne il motivo, entro dieci (10) giorni lavorativi decorrenti dal giorno del ricevimento dei Prodotti acquistati su elixar.it. - attrezzature per il benessere ed in particolare mobili, oggetti decorativi e da collezione, libri, giocattoli, giochi virtuali e fisici.
- prenotzione di formazione e coaching, di lezioni di allenamento fisico e mentale, e di tecniche di rilassamento e per il benessere.
Tutte le informazioni sulle caratteristiche essenziali dei Prodotti sono fornite allโinterno della scheda identificativa di ciascuno di essi. I prezzi dei Prodotti sono espressi in Euro e sono comprensivi di IVA. Sono esclusi i costi di spedizione, salvo diversa espressa indicazione. I prezzi indicati nel Sito potrebbero essere soggetti ad aggiornamenti, La invitiamo pertanto a verificare il prezzo finale di vendita prima di inoltrare il relativo Ordine dโAcquisto.
4. Modalitร di conclusione del contratto dโacquisto
4.1 Per concludere il contratto di acquisto di uno o piรน Prodotti su elixar.it, dopo aver selezionato il Prodotto o i Prodotti di Suo interesse, Lei dovrร anzitutto compilare e trasmettere al Venditore per via telematica un Ordine dโAcquisto dei Prodotti selezionati in formato elettronico (che vale come proposta contrattuale), indicando i Prodotti di cui chiede lโacquisto, il metodo di pagamento prescelto e alcuni Suoi dati personali necessari al recapito (di seguito lโOrdine dโAcquisto).
4.2. LโOrdine dโAcquisto si compone di una schermata di „Anagrafica“ nel quale lโutente dovrร indicare i dati personali necessari al recapito e di una schermata di selezione e attivazione del mezzo di pagamento prescelto (come meglio indicato allโarticolo 5 che segue). NellโOrdine dโAcquisto รจ altresรฌ contenuto un riepilogo: delle informazioni sulle caratteristiche essenziali di ciascun Prodotto ordinato e il relativo prezzo (comprensivo di IVA), dei mezzi di pagamento a disposizione per acquistare ciascun Prodotto, delle modalitร di consegna dei Prodotti, e dei costi di spedizione. 4.3. LโOrdine dโAcquisto sarร archiviato nella nostra banca dati per il periodo di tempo necessario all’evasione degli ordini (e comunque nei termini di legge). Lei potrร accedere in ogni momento al Suo Ordine dโAcquisto, per monitorarne lo stato collegandosi al Sito ed accedendo alla sezione „i miei ordini“ nella Sua pagina personale.
4.4. Il contratto รจ concluso quando il Venditore riceve e accetta, per via telematica, il Suo Ordine dโAcquisto, previa verifica della correttezza dei dati relativi al Suo ordine. Il Venditore potrร non dar corso agli Ordini d’Acquisto: (a) che non diano sufficienti garanzie di solvibilitร o che risultino incompleti o non corretti, ovvero (b) in caso di indisponibilitร dei Prodotti (qualora essi non siano piรน disponibili o in vendita). In questi casi, Elixar La informerร tempestivamente (ed in ogni caso entro trenta (30) giorni a decorrere dal giorno successivo a quello in cui Elixar avrร ricevuto il Suo Ordine dโAcquisto) per posta elettronica che il contratto non รจ concluso, specificandone i motivi. In caso Lei abbia giร versato il prezzo del Prodotto e le spese di spedizione, Le sarร rimborsato lโimporto corrispondente (come meglio indicato al successivo articolo 5). Nel caso in cui Elixar intenda concludere il contratto, Le trasmetterร , per posta elettronica, una ricevuta dell’ordine d’acquisto, contenente un riepilogo delle informazioni giร contenute nel Ordine dโAcquisto (Condizioni Generali di Vendita, Informativa sul diritto di recesso, le informazioni relative alle caratteristiche essenziali del prodotto e l’indicazione dettagliata del prezzo, dei mezzi di pagamento e dei costi di consegna).
5. Modalitร di pagamento
5.1. Al momento dellโinoltro dellโOrdine dโAcquisto Le verrร chiesto di scegliere una tra le seguenti modalitร di pagamento dei Prodotti: a) bonifico bancario anticipato intestato a Elixar SRL; b) PayPal; c) Carte di credito e prepagate Visa e Mastercard.
5.2. In caso di pagamento mediante bonifico bancario anticipato, riceverร conferma delle coordinate bancarie su cu cui effettuare il bonifico per posta elettronica unitamente alla ricevuta dโordine dโacquisto da parte di Elixar. Per confermare lโavvenuto pagamento dovrร inviare una copia della contabile bancaria via una e-mail con il numero di C.R.O.(Codice di Riferimento dellโOperazione) allโindirizzo administration@elixar.it. Il pagamento e la relativa comunicazione di avvenuto pagamento dovranno essere effettuati entro e non oltre cinque (5) giorni lavorativi dalla data dellโinvio dellโOrdine dโAcquisto. Elixar non evaderร gli ordini in caso di pagamenti e/o comunicazioni effettuati oltre il predetto termine. La invitiamo a verificare la completezza e la correttezza dei riferimenti e degli elementi essenziali del bonifico bancario. Dati mancanti o lโassenza di riferimenti necessari potranno provocare ritardi nellโevasione degli ordinativi e nella successiva consegna dei Prodotti.
5.3. In caso di acquisto mediante modalitร di pagamento PayPal, a conclusione della procedura di compilazione dellโOrdine dโAcquisto, Lei verrร automaticamente indirizzato alla pagina di login di PayPal. In questo modo lโimporto relativo allโordine verrร addebitato sul Suo conto PayPal al momento della ricezione dellโordine da parte di Elixar. In caso di successivo annullamento dellโordine, lโimporto rimborsato sarร addebitato sul Suo conto PayPal. In nessun caso Elixar potrร essere ritenuta responsabile per eventuali danni, diretti o indiretti, provocati da ritardi nel mancato svincolo dellโimporto impegnato da parte di PayPal. In nessuna fase della procedura di acquisto sul sito elixar.it, Elixar รจ in grado di accedere alle Sue informazioni finanziare o di conoscerle. Per ogni transazione eseguita con il conto PayPal, riceverร pertanto una e-mail di conferma direttamente da PayPal.
5.4. In caso di pagamento effettuato con carta di credito (circuiti Visa e Mastercard), le informazioni finanziarie (ad esempio, il numero della carta di credito/debito o la data della sua scadenza) saranno inoltrate, tramite protocollo crittografato, a Banca Intesa San Paolo senza che terzi possano, in alcun modo, avervi accesso. Tali informazioni, inoltre, non saranno mai utilizzate dal Venditore se non per completare le procedure relative al Suo acquisto e per emettere i relativi rimborsi in caso di eventuali restituzioni dei Prodotti, a seguito di esercizio del Suo diritto di recesso, ovvero qualora si renda necessario prevenire o segnalare alle forze di polizia la commissione di frodi su elixar.it. Il prezzo per l’acquisto dei Prodotti e le spese di spedizione, come indicate nell’Ordine dโAcquisto, saranno addebitati sul Suo conto corrente al momento della spedizione dei Prodotti acquistati.
6. Spedizione e consegna dei Prodotti
6.1. La spedizione dei Prodotti viene effettuata allโindirizzo indicato nellโOrdine dโAcquisto solo dopo la regolare registrazione del pagamento dellโordine relativo e dietro pagamento del prezzo. Non saranno effettuate consegne presso caselle postali. Salvo quanto previsto al precedente articolo 4.4, Elixar provvederร alla spedizione dei Prodotti entro e non oltre trenta (30) giorni a decorrere dal giorno successivo a quello in cui Elixar ha ricevuto lโOrdine dโAcquisto.
6.2. Spediamo in Italia, in Unione Europea e altri paesi fatta eccezione per le restrizioni legali e soggetta alla disponibilitร dei servizi di trasporto merci. Le consegne in Italia saranno perfezionate entro cinque (5) giorni lavorativi dalla data di spedizione, con esclusione dei sabati, delle domeniche e delle festivitร in genere. Le consegne in altri Stati membri dellโUnione Europea saranno invece perfezionate entro dieci (10) giorni lavorativi dalla data di spedizione. I termini di consegna appena indicati sono da considerarsi puramente indicativi, Elixar non sarร in alcun modo responsabile per eventuali ritardi di consegna dovuti a cause ad essa non imputabili.
6.3. In caso di acquisto di Prodotti appartenenti a categorie merceologiche distinte attraverso un solo ordinativo, i Prodotti potrebbero esserti consegnati in tempi diversi.
7. Qualitร dei Prodotti e garanzie
7.1. . Il Venditore non vende Prodotti usati o di qualitร inferiore ai corrispondenti standard offerti sul mercato. Lei รจ consapevole e accetta che le immagini ed i colori dei Prodotti offerti in vendita su elixar.it potrebbero tuttavia non essere corrispondenti a quelli reali per effetto del browser Internet e del monitor utilizzato.
7.2. Tutti i Prodotti disponibili su elixar.it sono garantiti per difetti di conformitร manifestatisi entro ventiquattro (24) mesi dalla consegna. Per esercitare la garanzia potrร scrivere a administration@elixar.it previa denuncia dei difetti in modo scritto ed inviare insieme al prodotto, nella confezione originale, unitamente alla fattura ed agli eventuali accessori – da indirizzare a Elixar secondo le modalitร indicate allโinterno della confezione del prodotto โ entro un (1) mese dalla scoperta. La invitiamo communque a contattare prima il nostro servizio clienti inviando unโe-mail al seguente indirizzo support@elixar.it entro il piรน breve tempo dalla scoperta dei difetti, per ottenere ulteriori informazioni relative alle modalitร di esercizio della garanzia. Elixar riserva la facoltร di verificare lโesistenza del difetto denunciato, e di effettuare la riparazione o la sostituzione solo successivamente a tale controllo. Ove a seguito di tale verifica il vizio non dovesse risultare un difetto di conformitร , il Venditore riserva il diritto di addebitare al Cliente i costi di verifica, ripristino, e trasporto.
8. Diritto di recesso
8.1. Lei ha il diritto di recedere dal contratto concluso con il Venditore, senza alcuna penalitร e senza specificarne il motivo. Per recedere dal contratto Lei dovrร innanzitutto inviare unโe-mail allโindirizzo administration@elixar.it, per ottenere il codice di autorizzazione reso e dovrร successivamente restituire i Prodotti allโindirizzo che Le verrร indicato via e-mail consegnandoli al corriere per la spedizione entro quattordici (14) giorni lavorativi che decorrono dalla data di comunicazione di recesso. Saranno a Suo carico le spese di spedizione, ivi compresa la responsabilitร in caso di smarrimento o danneggiamento dei Prodotti.
8.2. Il diritto di recesso – oltre al rispetto dei termini e delle modalitร descritte al precedente punto 8.1- si intende esercitato correttamente qualora siano interamente rispettate anche le seguenti condizioni: a) Il Modulo di reso deve essere correttamente compilato, indicando il codice di autorizzazione reso comunicato da Elixar e trasmesso congiuntamente al prodotto โ corredato dalla fattura dโacquisto – entro quattordici (14) giorni lavorativi dalla data di ricevimento dei Prodotti mediante posta electronica certificata inviata a elixar@pec.it oppure lettera raccomandata con ricevuta di ritorno inviata a [Elixar SRL – via Ponzetti 12 – Ponteranica 24010 (BG) – Italy]. Il diritto di recesso puรฒ essere esercitato entro lo stesso termine, anche attraverso una comunicazione via e-mail allโindirizzo administration@elixar.it confermata mediante lettera raccomandata con avviso di ricevimento โ corredata dalla fattura dโacquisto – inviata entro le quarantotto (48) ore successive; b) i Prodotti non devono essere stati utilizzati, indossati lavati o danneggiati; c) il cartellino identificativo deve essere ancora attaccato ai Prodotti con il sigillo monouso, che costituisce parte integrante dei Prodotti; d) i Prodotti devono essere restituiti in imballaggio integro, adeguatamente sigillato con confezione e contenuto integro, originale e completo; e) i Prodotti resi devono essere inviati al Venditore in una sola spedizione. Il Venditore, infatti, si riserva il diritto di non accettare Prodotti di uno stesso ordine, resi e spediti in momenti diversi.
8.3. Se il diritto di recesso รจ esercitato seguendo le modalitร ed i termini indicati in questo paragrafo 8, il Venditore provvede a rimborsare le eventuali somme giร incassate per l’acquisto dei Prodotti. Le somme Le verranno rimborsate nel minore tempo possibile ed, in ogni caso, entro quattordici (14) giorni dalla data in cui il Venditore รจ venuto a conoscenza dell’esercizio del Suo diritto di recesso, provvederemo ad attivare le procedure di rimborso ai sensi del successivo paragrafo 9, una volta verificata la corretta esecuzione dei termini e delle condizioni sopra indicate.
8.4. Qualora non siano rispettati le modalitร ed i termini per l’esercizio del Suo diritto di recesso, come specificato in questo paragrafo 8, Lei non avrร diritto al rimborso delle somme giร corrisposte al Venditore; tuttavia, potrร riottenere, a Sue spese, i Prodotti nello stato in cui sono stati restituiti al Venditore. In caso contrario, il Venditore potrร trattenere i Prodotti, oltre alle somme giร pagate per il loro acquisto.
9. Tempi e modalitร di rimborso
9.1. Dopo la restituzione dei Prodotti, il Venditore provvede ai necessari accertamenti relativi alla conformitร degli stessi alle condizioni ed ai termini indicati nel paragrafo 8.1. e 8.2. Nel caso in cui le verifiche si concludano positivamente, il Venditore provvede ad inviarLe, via posta elettronica, la relativa conferma dell’accettazione dei Prodotti cosรฌ restituiti.
9.2. Qualunque sia la modalitร di pagamento da Lei utilizzata, la procedura di rimborso รจ attivata dal Venditore nel minore tempo possibile e comunque entro quattordici (14) giorni dalla data in cui il Venditore รจ venuto a conoscenza dell’esercizio del Suo diritto di recesso previa verifica della corretta esecuzione del Suo diritto di recesso ed accettazione dei Prodotti restituiti.
9.3. Qualora non vi sia corrispondenza tra il destinatario dei Prodotti indicato nellโOrdine dโAcquisto e chi ha eseguito il pagamento delle somme dovute per il loro acquisto, il rimborso delle somme, in caso di esercizio del diritto di recesso, sarร eseguito dal Venditore, in ogni caso, nei confronti di chi ha effettuato il pagamento.
10. Diritti di proprietร intellettuale
ll marchio Elixar – Alchemy of the Senses, il logo Fiamma della Vita (Flame of Life), il concetto OlfaTeam, il concetto Infin’Em, e i marchi di profumi Alkyres, Olfimรฉ, Qelia, Zahemi, esKiss, Attar-Enos, Attar-Vea; cosรฌ come tutti gli altri marchi, registrati o meno e tutti gli altri segni distintivi quali denominazioni sociali, nomi e denominazioni commerciali, illustrazioni, immagini, loghi, disegni registrati e non registrati, diritti dโautore e brevetti („Diritti di Proprietร Intellettuale“), che figurano sui Prodotti o altrimenti riprodotti sul sito web elixar.it, su accessori o imballaggi, sono e rimangono di proprietร esclusiva di Elixar SRL. Qualsiasi riproduzione, anche parziale, qualunque modifica o uso dei Diritti di Proprietร Intellettuale, per qualsivoglia ragione e in qualsiasi forma, senza la preventiva autorizzazione di Elixar SRL espressa in forma scritta, รจ assolutamente proibita. ร altresรฌ proibita qualsiasi combinazione o uso in concomitanza con qualunque altro marchio, simbolo, logo e piรน in generale ogni altro segno distintivo atto a formare un segno complesso.
Il Sito puรฒ presentare foto, video, corsi, metodi e citazioni di dipendenti, agenti, collaboratori, contributori pro-bono o fornitori (ad esempio in The Tribe). Tali pubblicazioni su elixar.it o sui canali social di Elixar sono soggette ad accordi espressi che possono essere esclusivi tra Elixar SRL e i soggetti. Di conseguenza, tali contenuti non devono essere interpretati erroneamente come parte di pubblico dominio.

11. Forza maggiore
Elixar sarร sollevata da qualsiasi obbligo contrattuale di fare o di consegnare e non sarร tenuta a corrispondere alcuna indennitร in caso di eventi di forza maggiore che impediscano lโadempimento di obbligazioni poste a suo carico, quali a mero titolo esemplificativo sommosse, insurrezioni, disordini sociali, crisi sanitarie, guasti telefonici o informatici o grave lesione alla sicurezza e alla operativitร di internet, scioperi ed impossibilitร di approvvigionamento di Prodotti e materiali.

13. Legge applicabile e soluzione delle controversie
13.1 Le Condizioni Generali di Vendita sono regolate dalla legge italiana ed in particolare dal D.Lgs. 6 settembre 2005 n. 206 (Codice del Consumo) con specifico riferimento alla normativa in materia di contratti a distanza e dal D.Lgs. 9 aprile 2003 n. 70 su taluni aspetti concernenti il commercio elettronico.

Nel caso di controversie tra il Venditore e ciascun utente finale, nascenti dalle Condizioni Generali di Vendita, il Venditore garantisce, sin d’ora, la piena adesione ed accettazione del servizio del Associazione Italiana per il Commercio Elettronico (AICEL) o di conciliazione Online Dispute Resolution (ODR). ODR รจ un servizio indipendente ed istituzionale, fornito dalla Commissione Europea, che consente di raggiungere un accordo soddisfacente, con l’aiuto di un conciliatore neutrale e competente, in un modo amichevole e sicuro, su Internet.
